Terms and Conditions

Agroptima, SL (from now on Agroptima), with NIF B66350497, is the company Agroptima provider of service. Agroptima offers a farm management software designed for farmers, technicians and cooperatives across the web www.agroptima.com and its subdomains (from now on”Service”).

Please read these terms of use carefully before using our service. These Terms of Use govern your access and our Customer Service and your use of it.

It is understood that you accept these terms of use from the moment you create an account with Agroptima as inform you on the registration form.

If you accept these terms of use on behalf of your company or another entity, you represent and warrant that (i) accounts with sufficient legal authority to bind your company or entity to these terms and conditions, (ii) you have read and understood these terms of use and (iii) agree to the terms of use on behalf of the party you represent. If you do not have the necessary legal authority to accept this relationship, stop with the hiring of Service.

New features can be added to our Service, subject to the terms of use. If the Customer continues to use Service after any such modification, Customer shall indicate conformity with these modifications.

Failure of any of this terms of use may cause the  interruption of the Service.

1. Account

The Customer agrees to provide full legal name, a valid email address and any other information required to complete the registration process.

You are responsible for maintaining the confidentiality of your account. Agroptima is not responsible for any damage or loss that may result from his mistake to protect your login information, including your password.

2. Create the account and period of trail

The Client creates its own account through the website www.agroptima.com

Right after, you can access to your account and have 15 days to try the service without any commitment or payment.

During this period the customer could decide to buy Agroptima service. If the end of the trial period comes the Customer shall make payment of the service electronically to continue using it.

If Customer fails to make the payment, it is understood that decides not to continue with the service and data that had been accumulated in your account will remain for 60 days to servers and can be retrieved if that customer decide to pay the service.

3. Payment and Access

The service is charged in a form of annual fee and is non-refundable. The service can be paid by credit card if this form is available at the time of payment.

If payment is unpaid will be notified and  if payment is not made will lost the ability to access the Service automatically.

The fees do not include taxes.

4. Modification of service and fees

Agroptima reserves the right to modify or discontinue, temporarily or permanently, the Service at any time convenient or force majeure.

Agroptima reserves the right to change fees with 15 days notice. Notification of change of assessments will be published on the website of Agroptima.

5. Cancellation and Termination

Customer may cancel at any time by sending an email to soporte@agroptima.com

Once canceled your account, you can decide to keep your data to our server communicating it by email to soporte@agroptima.com. If there is no communication with this purpose the content of your account will be removed within 60 days.

6. General Conditions

Customer is responsable for the access and correct use of Agroptima subject to the law, whether national or international, as well as the principles of good faith, morals, good customs and public order. And specifically, it undertakes to read and diligently applying these Terms of Service.

You agree not to resell, duplicate, reproduce or exploit any portion of the Service without the written Agroptima explicit consent. You may not use the Service to store or send malicious email or unsolicited (spam). Nor can use the service to transmit any viruses, worms, or other malicious or hateful content.

Agroptima is not responsible for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages arising out of or relating in any way to your use of the Service Client. Only the customer can solve dissatisfaction leaving service use and canceling your account.

If any condition written here is invalidated or may not apply, the application of any of the remaining will not be affected in any way.

The Customer agrees that it will not be necessary to confirm receipt of the acceptance of these conditions when contracting the service has been carried out exclusively by electronic communication.

The Terms of Use, establish a complete understanding between the Customer and Agroptima on the Service and prevail over any prior agreement between you and Agroptima.

Agroptima reserves the right to cancel an account or prevent the use of the service to those who violate these Terms of Use. Agroptima reserves the right to update and change the Terms of Use at any time.

Terms and relationship of Customers with Agroptima will be respecting these Terms, they are governed by the laws of Spain. Customer and Agroptima agree to submit to the exclusive jurisdiction of the courts of Barcelona to resolve any legal matter arising from the Terms.
